These Terms of Service ("Terms") govern your access to and use of the ReefDex mobile application, website at reefdex.app, and related services (collectively, the "Service"), operated by ReefDex ("we", "our", "us"), a sole proprietorship based in the Netherlands.
By creating an account, accessing, or using the Service, you ("you", "User") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. The Service is not directed at children under 13 and we do not knowingly collect personal data from them. If you live in a country where the digital age of consent is higher than 13 under the GDPR (e.g., 16 in several EU member states), that higher age applies to you.
To access most features you must create an account via email/password or Google Sign-In. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials. You must notify us immediately at henkvdmolen1@gmail.com of any unauthorized use.
You may hold one personal account. You may not create accounts through automated means, using false identities, or on behalf of someone else without authorization.
ReefDex provides tools for recreational scuba divers and snorkelers, including (a) digital dive logging, (b) AI-assisted identification of marine species from photographs and video, (c) a map of dive sites, (d) a community feed, (e) a species collection and achievement system, and (f) cross-referencing with public taxonomic databases such as the World Register of Marine Species (WoRMS), the Global Biodiversity Information Facility (GBIF), and iNaturalist.
The Service is provided both as a web application and as mobile applications for Android and iOS (where available).
You agree not to:
You retain all ownership rights in the photos, videos, dive logs, notes, and other content you submit to the Service ("User Content"). We do not claim ownership of your User Content.
To operate and improve the Service, you grant ReefDex a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g., create thumbnails), publish (where you have made the content public), and display your User Content solely for the purposes of providing, improving, and promoting the Service. This license ends when you delete the relevant content, except where (i) you have shared it with others who have not deleted it, or (ii) it is required for backup, legal, or audit purposes for a reasonable period.
Your observation data consists of non-personal facts derived from your submissions: species identification, taxonomic identifiers (e.g., WoRMS AphiaID, GBIF taxon key, iNaturalist taxon ID), GPS coordinates, date/time, depth, and water conditions — excluding your photos, name, email, or any other personal identifier. You grant ReefDex a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, aggregate, anonymize, and share this observation data for scientific, conservation, educational, and commercial research purposes, including but not limited to sharing with public biodiversity databases (such as GBIF), research institutions, NGOs (such as IUCN and WWF), and commercial partners. See Section 5 for details.
By default, your photos and videos are private and are used only to (a) provide the identification feature to you, and (b) be stored in your personal dive logs. Photos are sent to Google's Gemini AI service for real-time analysis and are not retained by us or, to our knowledge, by Google's generative AI API beyond processing. We will not use your photos to train machine learning models without your explicit opt-in consent.
If in the future you choose to publish a photo to the public community feed, you additionally grant us and other users a license to view and interact with that photo within the Service. You may remove a public photo at any time.
You represent and warrant that: (a) you own or have the necessary rights to the User Content you submit; (b) your content does not violate any third party's intellectual property, privacy, or publicity rights; (c) information in your dive logs and observations is, to the best of your knowledge, accurate; (d) you have any permits required by local regulations for the activities depicted (e.g., diving in a marine protected area).
ReefDex has a stated mission to contribute to marine conservation by making biodiversity observation data useful to researchers. By using the Service you acknowledge and agree that:
If you object to the inclusion of your observation data in shared datasets, you may either refrain from using the Service or contact us to request exclusion. Exclusion requests apply prospectively; previously shared anonymized data cannot always be recalled from public datasets.
ReefDex uses artificial intelligence (currently Google Gemini) combined with lookups in public taxonomic databases to suggest species identifications. These suggestions are probabilistic estimates, not authoritative determinations.
Do not rely on ReefDex identifications for any decision where being wrong could cause harm, including but not limited to: determining whether an animal is venomous, dangerous, protected, edible, or suitable for handling; making commercial fishing decisions; making legal, regulatory, or compliance determinations; or any medical decision.
The Service may identify common species with reasonable accuracy, rare species poorly, and may occasionally "hallucinate" species that are not actually present. Always verify critical identifications with a qualified marine biologist or an authoritative scientific source.
Scuba diving, snorkeling, and freediving are activities with inherent risk of serious injury or death. ReefDex is an educational and logging tool. It is not a dive computer, not a safety device, and not a substitute for proper training, certification, dive planning, buddy procedures, or adherence to manufacturer-specified limits of any diving equipment.
You are solely responsible for your own safety, your dive planning, your equipment, and your compliance with the laws and regulations of the jurisdictions in which you dive. Data shown in the Service (dive site info, depths, conditions, species warnings) may be incomplete, outdated, or incorrect.
The Service, including software, design, logos, the "ReefDex" name, the species collection and badge system, visual assets, and compilations of data (excluding your User Content and third-party content), is owned by ReefDex and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms. No other rights are granted by implication, estoppel, or otherwise.
The Service integrates or links with third-party services including but not limited to Supabase (database, authentication), Google Gemini (AI), Google Maps (mapping), Google Sign-In (authentication), Stripe (payments), Vercel (hosting), WoRMS, GBIF, and iNaturalist (taxonomic data). Your use of these services is governed by their own terms and privacy policies, which we do not control and are not responsible for.
Certain features may require payment. Prices are displayed in the Service and are exclusive of any applicable taxes unless stated otherwise. Payments are processed by Stripe; by paying, you also agree to Stripe's terms. We do not store your full card details.
Subscription plans renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you will retain access until that date. We do not provide refunds for partial billing periods except where required by law.
A "Lifetime Deal" grants you one-time-paid access to the set of features expressly included in the LTD offer at the time of purchase, for as long as the Service remains operational and you continue to comply with these Terms. A Lifetime Deal:
Except where mandatory consumer law applies (see Section 11), all payments are final. We may, at our discretion, offer refunds on a case-by-case basis.
We may change the price of subscriptions with at least 30 days' notice. Price changes do not apply retroactively to already-paid periods. Lifetime Deal purchases are not affected by subsequent price changes for the features originally included.
If you are a consumer resident in the European Union, EEA, or United Kingdom, you have a statutory right to withdraw from a distance contract for digital services within 14 days of purchase. However, you expressly acknowledge and agree that:

We respect intellectual property rights and respond to valid notices of claimed infringement. If you believe content on ReefDex infringes your copyright, send a written notice to henkvdmolen1@gmail.com including:
We may remove or disable content we reasonably believe to be infringing and terminate accounts of repeat infringers.
You may delete your account at any time by contacting us or using an in-app deletion feature where available. Deletion removes your personal data within a reasonable time, subject to legal retention requirements and excluding anonymized observation data as described in Section 5.
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or if required by law. Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 4.3, 5, 8, 15, 16, 17, and 18) will survive.
We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide notice of material changes.
We may update these Terms from time to time. If the changes are material, we will notify you by email and/or by posting a notice in the Service at least 30 days before they take effect, unless a shorter period is required by law or for security. Continued use of the Service after the effective date constitutes acceptance. If you do not accept the changes, you must stop using the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, OR THAT IDENTIFICATIONS OR DATA DISPLAYED ARE ACCURATE.
Some jurisdictions do not allow exclusion of implied warranties; in those jurisdictions, our warranties are limited to the minimum extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REEFDEX AND ITS OPERATORS, OWNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) EUR 50.
Nothing in these Terms limits or excludes liability for fraud, gross negligence, willful misconduct, or any liability that cannot be limited by law (e.g., liability for death or personal injury caused by negligence in jurisdictions where this cannot be waived).
You agree to indemnify, defend, and hold harmless ReefDex and its operators from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party right, including intellectual property or privacy rights; and (e) your violation of any applicable law or regulation.
These Terms are governed by the laws of the Netherlands, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
Any dispute arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Netherlands, except that EU consumers may also bring proceedings in the courts of their country of residence as provided by mandatory consumer law. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
Entire Agreement. These Terms, together with our Privacy Policy and any additional terms you accept when using specific features, constitute the entire agreement between you and ReefDex regarding the Service and supersede any prior agreements.
Severability. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms, for example in connection with a merger, acquisition, or sale of assets, with reasonable notice.
Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, internet outages, acts of government, or third-party infrastructure failures.
Independent Contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
Language. These Terms are drafted in English. In the event of a translation, the English version prevails in case of conflict.
